This is not a competitive bid The Utah Procurement Code provides that a procurement may be made without competition when there is only one source for the required supply or service. Therefore “sole source” procurement is justified if there is only one product or service that can reasonably meet the state’s need and there is only one vendor who can provide the product or service. The Division of Purchasing has received a request to make the following sole source procurement. Requesting Agency: Utah State Department of Education Product and/or service to be purchased: Utah online Migrant Achievement & Performance System (MAPS) including State Migrant Education Program Comprehensive Needs Assessment/State Service Delivery Plan/Migrant Program Evaluation and Migrant Program Reinterview Contract Length: 5 year Contract Proposed Sole Source Supplier: Educational Research and Training Corporation (ERTC) Estimated Total: $595,000 Sole Source Justification: MAPS is used to certify eligibility for migrant students, identify
those students who are priority for service, identify student needs, maintain data for program evalaution, connect with and upload data to MSIX and collect all the necessary data for the CSPR. MAPS is used to randomly select COE's for review and for the ReInterview Initiative. MAPS is the only system that provides all of these processes in one interconnected system. MAPS is the only system nationally that incorporates all of the statutorily mandated program components into one system. There are no other systems or suppliers that provide this item. The MAPS system was also designed specifcally to meet Utahs' unique needs in migrant education. The system is compatible with Utah program and meets all of the compliance requirements of Title 1 - PArt C MEP funds. The services and software provided are only available comprehensively through the MAPS system which Utah has been utilizing for 7 years. The specific components of the MAPS

system are exclusively propietary to ERTC and have been designed specifcally to meet Utah Migrant Program specifications. ERTC is the sole proprietor of the MAPS system. This system is copy righted by ERTC, they allow no outside sellers or distributors. Earliest Date for purchase: 02/18/2015 Action To Be Taken: No action is required if you agree this proposed purchase is a valid sole source.
