LEGAL NOTICE NO. 14-7580 Sealed Proposals endorsed "TOWNE BOULEVARD ROADWAY IMPROVEMENTS” will be received at the office of st the Engineering Division, City Building, Middletown, Ohio, until ten (10) o'clock Local Time, on FRIDAY, the 31 of JANUARY, 2014 and at that time publicly opened and read aloud in the Conference Room of the Engineering Division for all labor, materials and equipment as shown on the plans and described in the specifications on file in the office of the Engineering Division. This project consists of minor widening of Towne Boulevard. from Village Drive to Meijer, including the replacement of curb and gutter, concrete driveways, storm sewer, a retaining wall, and pavement rehabilitation. The traffic signals at the intersections of Village Drive and Towne Boulevard, and Krogers and Towne Boulevard will be reconstructed. All work shall be completed and acceptable by November 1, 2014. The plans and specifications are on file, and may be obtained from the office of the Engineering Division, City Building, Middletown. The charge for these plans and specifications is $40 (non-refundable). All proposals shall be made and properly executed on proposal forms as issued by the City and bound together with other documents and specifications. All proposals containing bids not asked for or which are otherwise not in conformity with this notice will be considered informal and may be rejected. Each bidder is required to state in his proposal his name and place of residence and the names of all persons interested with him. In the case of a corporation, only the names of the President and Secretary will be given. No bid will be allowed to be withdrawn after it has been deposited with the Engineering Division. A certified check on a solvent bank, drawn and made payable to the Treasurer of the City of Middletown, Ohio, or a bid bond by a surety company licensed to do business in Ohio, in a sum not less than 5% of the total amount of the bid, as surety for the execution of the contract shall accompany each proposal. The checks of all bidders will be returned upon the execution and securing of the contract. Bidders must comply with the Federal Prevailing Wage Rates on Public Improvements in Butler County and the City of Middletown, Ohio as determined by the U. S. Department of Labor under the Davis-Bacon and related Acts, Wage and Hour Division. The successful bidder will be required to execute the contract and to provide a 100% performance bond within ten (10) days after the award of the contract to him. In case the bidder neglects to so execute the contract, the check accompanying the proposal shall be forfeited to the City of Middletown, not as a penalty, but as liquidated damages. Prior to submitting a bid contractors must certify that they have met the requirements of the Ohio Bureau of Worker’s Compensation’s (BWC) Drug Free Workplace Program to be eligible for state funded construction projects including grants within ten days of the bid award. The bid will be deemed non-responsive and not eligible for the award of contracts if this certification is not met. The right to reject any or all bids is reserved by the City of Middletown.
