President’s Message

I was glad to greet our members at the Installation Cocktail Party on January 30. It was fortunately, one of the few evenings that the great Chicago snow machine was not in full operation. Thank you to all of you that braved the frigid temperatures to meet our 2014 Board of Directors. As a Board, we appreciate that our members continue to stay involved and active in the Chamber. The Chamber, after all, is only as strong as its members’ involvement. I hope you had the chance to attend the Mayor’s State of the Village Address Luncheon. We are always honored that the Mayor chooses to share his annual address with the business community at our Monthly Membership meeting. Keeping the business community apprised

Business Survey Thank you too to the many businesses that participated in the village’s business survey conducted in cooperation with the chamber. Last year, the village contracted with the National Research Center (NRC) to conduct the community business survey, the results for which can be found on the village’s website at The top five key findings among the participating businesses included Orland Park being a good place to do business. Respondents appreciated features that support Orland Park business. Transportation continues to be a concern. Local businesses lauded the performance of local government and most businesses surveyed plan to expand in the coming years.

Thank you to the chamber for again hosting the State of the Village Address on February 26. It was great to see so many of you. The luncheon format was new this year and seemed to be more convenient for business people. As you heard at the luncheon, we have many exciting things happening in Orland Park and we’re looking forward to more successes during this, the village’s 122nd year.

Looking Back at 2013 Nearly 120 new business licenses were issued in 2013 with new businesses including Bonefish Grill, Uncle Julio’s, Buona Beef, Bear Paddle Swim School, Mama Maria’s Taco and Tequila Bar, Boombah, Art Van Furniture, Orange Theory Fitness, Naf Naf Grill, Joy of Thai, Q Restaurant, Vera Bradley and the 179th Street McDonald’s.

Illinois to receive a perfect score from the institute. The village’s retail vacancy rate for 2013 was 3.87%, significantly lower than Chicago’s retail vacancy rate at 8.5% (CPRE) and the national rate at 10.5% (Reis). Public Safety The 2013 holiday season brought expanded shopping hours at many local stores with Orland Square and other retail locations open on Thanksgiving. The Police Department had additional officers patrolling on foot at Orland Square and other retail areas throughout the holiday season.

Construction of Flaherty and Collins’s Ninety7Fifty on the Park was completed in 2013 with more than 70% of the units leased with full occupancy expected by this summer. The village continues its involvement with the Illinois Department of Transportation’s widening of LaGrange Road/US Route 45 --- one of the largest infrastructure improvement projects in the history of the village.

The Police Department’s “retail details” had pairs of officers driving from one retail area to the next, getting out and walking and talking and entering the stores to speak with the proprietors. Undercover officers worked with loss prevention officials at stores throughout the community, working together to target the more sophisticated people involved in retail theft. Early data shows that overall retail theft decreased 13.2 % from the previous year.

The village applied for and secured a ComEd grant to facilitate the planning of the proposed nature center at the former Pebble Creek Nursery site at 139th and LaGrange Road. The Village of Orland Park secured a 100% transparency rating from the Illinois Policy Institute for the third consecutive year. Orland Park was the first municipality in the State of

Plan Now for ACA’s Tax-Related Provisions

Companies face a variety of taxrelated compliance requirements under the newly adopted Affordable Care Act. Certain small organizations may be eligible for a taxsaving opportunity before 2014. Many of the health care act’s tax-related provisions require employers to act this year and next. So it’s important to take time now to determine what you need to do before the year-end. Here is an overview of the key provisions and proposed IRS guidance. Additional rules apply, so be sure to consult your tax advisor to determine exactly how your organization will be affected. Premium tax credit. This tax credit has been around since 2010 when the healthcare law was first passed. Certain small businesses are eligible for a 35% tax credit of the premiums they pay for their employees. In order to qualify, a business must have fewer than 25 full time equivalent employees and pay at least 50% of the premiums. There are key changes starting in January of 2014 for this tax credit. The first is that in order to qualify for the credit, a small business must purchase their health insurance plan through the health insurance exchange. A second change is the credit increases from 35% to 50% of the employers cost. A third change starting in 2014 is an employer can only claim the credit for an additional two years. The two years do not necessarily have to be 2014 and 2015. This could be a planning opportunity if changes are expected to the amount of premiums a company will pay, or changes in the health insurance plan offered. Medicare withholding There were two major new taxes created with the passage of the healthcare law. The first being a new

.9% Medicare tax on earned income. A taxpayer is responsible for this tax once earned income is over 200,000 for single filers or 250,000 for joint filers. However, employers are responsible for withholding the .9% tax once the wages for an individual employee exceeds 200,000, and employers do not take into account the filing status of employees. This has the potential for an employee to have the tax withheld but they actually do not owe the tax when they file their 1040. If a married taxpayer earns 210,000 they will have the withholding on 10,000 of wages (the amount in excess of 200,000). However, since the threshold for a joint filer is 250,000, the amount withheld will be refunded to the taxpayer. The reverse side of this example could happen as well. If both spouses earn 190,000, neither will have the tax withheld on their paychecks, however they will be responsible for paying the portion above 250,000. Tax planning is essential in this case. Tax on unearned income The other new tax created is commonly referred to as the net investment income tax. This is a tax that is assessed on “unearned income”. Common income sources that are subject to this tax include interest income, except tax exempt interest, dividend income, capital distributions, capital gains from stock sales, and rental income. Some income items are excluded from this tax. This includes wages, self-employment income, social security income, retirement distributions, and unemployment compensation. Operating income from pass through entities (such as an S-Corporation) where there is active participation by the shareholder is also exempt. If the shareholder does not have active participation, the income from that entity will be subject to the 3.8% tax. Both of these lists are not all inclusive, and you should check with your tax advisor for specific situations.

Established in 2010, it is a 501(c)(6) not-for-profit organization and a nonpartisan, member driven organization that promotes the success of small business through political advocacy, support services and educational programs. Your Orland Park Area Chamber is one of several Illinois chambers that are Coalition Partners which support SBAC advocacy efforts on an issue-based basis. The SBAC understands the importance of banding together and creating critical mass in providing small business owners and our employees the voice we deserve. Through this partnership, together we push forward non-partisan, common sense legislation that improves the environment for the small business community. The SBAC took a leadership role in bringing a health insurance cooperative for small businesses and entrepreneurs to Illinois. We also championed a law setting a goal for 10% of all state procurement contracts to be issued to small businesses.

Our current legislative agenda tackles the fees associated with filing and operating an LLC in Illinois, which are the highest in the nation. We are also calling for greater transparency in Illinois’ EDGE Tax Credit Program and assurance that this economic development program is indeed good public policy. Our leadership and business owner members continue to champion fair practices and our lobbying efforts have given small business owners a voice in Springfield and Washington DC.

Orland Township’s monthly television program, Township Tempo, is now on air!
