General Overview Request for Proposals Weber Area Dispatch 911 & Emergency Services District (the District) invites qualified public safety software vendors to submit responses to this Request for Proposals (RFP). The District will use the information to purchase software that best meets the District’s needs. The District is a consolidated PSAP serving 26 local, state and federal agencies in Weber and Morgan Counties. We are a multi-jurisdictional, multi-discipline PSAP with over 70 employees. The current system is managed, maintained and governed by guidelines set up in a governance policy. Currently the District has financial responsibility for the system, and employs the IT personnel and the database specialist that maintain the core system. Additionally, the District contracts with a GIS Specialist to manage the GIS dataset and geo loads for both counties. The Governance policy requires strong agency participation and the District maintains a strong working relationship with all agencies. Furthermore, District employees are involved with every committee outlined in the governance policy and play an active role in all issues related to the system. Proposal Submission   

    

Submit 5 (five) printed copies. A response to all questions is required. Proposals must be submitted in a sealed box or envelope to the address below. Weber County Purchasing c/o Annette Jacobs, Purchasing Agent 2380 Washington Blvd, #320 Ogden, UT 84401 Proposal package must be labeled as follows: Project name Vendor name The vendor is responsible for all costs incurred in the preparation, demonstration, or negotiation of this proposal. The Agency reserves the right to reject all RFPs in their entirety or to select certain application software from the RFPs. The Agency reserves the right to award the contract in any manner deemed in the best interest of its citizens. All proposals, including attachments, supplementary materials, agenda, etc shall become the property of the Agency and will not be returned to the offeror. Confidentiality: All responses, inquiries, and correspondence relating to this RFP and all reports, charts, displays, schedules, exhibits, and other documentation produced by the offeror that are submitted to the Agency, as part of the proposal or otherwise, shall become the property of the Agency when received by the Agency and may be considered public information under applicable law. The Agency is subject to the disclosure requirements of the Government Records Access and Management Act, title 63G, Chapter 2, Utah Code Annotated (“GRAMA”). The Agency generally considers proposals and all accompanying material to be public and subject to disclosure. Any material considered by the offeror to be proprietary must be accompanied by a written claim of business confidentiality and a concise written statement of reasons supporting the claim. Blanket claims that the entire RFP is confidential will be denied. The Agency cannot guarantee that any information will be held confidential. If the offeror makes a claim of business confidentiality, the Agency, upon receipt of a request for disclosure, will determine whether the material should be classified as public or nonpublic, and will notify the offeror of such determination. The offeror is entitled under GRAMA to appeal an adverse determination. The Agency is not obligated to notify the offeror of a request to see the offeror’s proposal, and will not consider a claim of confidentiality, unless the offeror’s claim of confidentiality is made in a timely basis and in accordance with GRAMA.

Proposal Format Vendors must organize their proposals in the following format:       

Letter of Transmittal Table of Contents Executive Summary Proposal Questionnaire (RFP Section 1.) Functional Specifications (RFP Section 2.) Pricing (RFP Section 3.) Attachments

Evaluation Criteria The primary criteria for vendor evaluation and consideration are:  Market Focus (Public Safety Specific)  Stability (Financial Viability, Business Longevity, National Focus)  Warranty, maintenance and support  Customer Service (customer references, retention, measured service rates, 24x7 support)  Ability to provide a comprehensive, integrated solution to meet the stated requirements  Pricing Evaluation of the proposals is expected to be completed within 60 days after receipt. An evaluation team will evaluate proposals on a variety of quantitative and qualitative criteria. The proposal selected shall provide the most costeffective approach that meets the stated requirements. The District reserves the right to a) reject any or all proposals, or to make no award, b) require modifications to initial proposals or c) to make partial or multiple awards. The District further reserves the right to excuse technical defects in a proposal when, in its sole discretion, such excuse is beneficial to the District. The District may award based on initial proposals received, without discussion of such proposals. Selected vendors may be invited to make oral presentations to the evaluation team. The acceptance by the Administrative Control Board of the proposal shall create a binding and enforceable Contract of Sale with the District, dating from the time of said acceptance, without further action by either party and even though a written purchase order has not been furnished to or received by the successful proposer. Said created Contract of Sale shall include all of the provisions and specifications of the RFP, offer, acceptance and purchase order relating thereto. Said contract shall be interpreted, construed, and given effect in all respects according to the laws of the State of Utah and the Ordinance of Weber County and shall not be assignable by the vendor in whole or in part without the written consent of the District.

Other Proposal Terms and Conditions 



The Right to Withdraw: The District reserves the right to cancel and/or withdraw this Request for Proposal at any time that it shall be in the best interest of the District to do so. If the Request for Proposal is withdrawn, notice will be mailed to the prospective proposers as soon as possible. Debarment: the bidder certifies that neither it nor its principals are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this 3

transaction (contract) by any governmental department or agency. If the bidder cannot certify this statement, attach a written explanation for review by the District. Certify Registration and Use of Employment “Status Verification System”: The Status Verification System, also referred to as “E-verify”, only applies to contract issued through a Request for Proposal process, and to sole sources that are included within a Request for Proposal. o Status Verification System  Each offeror and each person signing on behalf of any offeror certifies as to its own entity, under penalty of perjury, that the named Contractor has registered and is participating in the Status Verification System to verify the work eligibility status of the contractor’s new employees that are employed in the State of Utah in accordance with UCA Section 63G-11-103.  The Contractor shall require that the following provision be placed n each subcontract at every tier: “The subcontractor shall certify to the main (prime or general) contractor by affidavit that the subcontractor has verified through the Status Verification System the employment status of each new employee of the respective subcontractor, all in accordance with Section 63G-11-103 and to comply with all applicable employee status verification laws. Such affidavit must be provided prior to the notice to proceed for the subcontractor to perform the work”.  The District will not consider a proposal for award, nor will it make any award where there has not been compliance with this Section.  Manually or electronically signing the Proposal is deemed the Contractor’s certification of compliance with all provisions of this employment status verification certification required by all applicable status verification laws including UCA Section 63G-11-103. Indemnity Clause for Status Verification System o Contractor (includes, but not limited to, any contractor, design professional, designer or consultant) shall protect, indemnify and hold harmless, the District and its officers, employees, agents, representatives, and anyone that the District may be liable for, against any claim, damages or liability arising out of or resulting from violations of the above Status Verification System Section whether violated by employees, , agents, or contractors of the following: (a) contractor; (b) subcontractor at any tier; and/or (c)_ any entity or person for whom the contractor or subcontractor may be liable. o Notwithstanding the above paragraph, design professionals or designers under direct contract with the District shall only be required to indemnify the District for a liability claim that arises out of the design professional’s services, unless the liability claim arises from the design professional’s negligent act, wrongful act, error or omission, or other liability imposed by law except that the design professional shall be required to indemnify the District in regard to subcontractors or subconsultants at any tier that are under the direct or indirect control or responsibility of the deign professional, and includes all independent contractors, agents, employees, or anyone else for whom the design professional may be liable at any tier. Proprietary Information: Suppliers are required to mark any specific information contained in their bid which is not to be disclosed to the public or used for purposes other than the evaluation of the bid. Each request for nondisclosure must be accompanied by a specific justification explaining why the information is to be protected. Pricing and service elements of any bid will not be considered proprietary. Bids submitted may be reviewed and evaluated by any person at the discretion of the District. Trade/Professional Licensing: The State of Utah requires any person engaging in a construction trade or professional occupation, or acting as, or representing oneself as a contractor or professional for which licensure is required to be licensed before engaging in that trade professional activity. It is unlawful for any unlicensed person to submit a bid for any work for which a license is required. Any

person who violates this provision cannot be awarded or accept a contract for the performance of the work. Employment Practices Clause: The bidder agrees to abide by the provisions of the Utah Antidiscrimination Act, Title 34, Chapter 35, U.C.A. 1953, as amended and Title VI and VII of the Civil Rights Act of 1964 (42USC 2000e), which prohibits discrimination against any employee or applicant for employment or any applicant or recipient of services, on the basis of race, religion, color, or national origin, and further agrees to abide by Executive Order No. 11246, as amended, which prohibits discrimination on the basis of sex; 45 CFR 90 which prohibits discrimination on the basis of age, and Section 504 of the Rehabilitation Act of 1973, or the Americans with Disabilities Act of 1990 which prohibits discrimination on the basis of disabilities. Also, bidder agrees to abide by Utah’s Executive Order, dated March 17, 1993, which prohibits sexual harassment in the work place. Bidder must include this provision in every subcontract or purchase order relating to purchases by the District to insure that the subcontractors and vendors are bound by this provision.
